The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions. The Department also represents the State in criminal appeals from state trial courts, and brings legal actions on behalf of the state and its citizens when the public interest is at stake.
This position is not subject to the Fair Labor Standards Act.This position is located in the Consumer Protection section of the Legal Division of the N.C. Department of Justice.
The primary purpose of the Division is to carry out the Attorney General's duty to enforce the State's laws prohibiting unfair or deceptive commercial practices, unfair methods of competition, and combinations and conspiracies in restraint of trade. This Division responds to questions from the general public and state officials relating to consumer matters. The Division mediates many of the complaints received and investigates and litigates violations of law.
Prepare, file and litigate cases in trial and appellate courts where negotiation of appropriate settlement is not possible. Draft and file briefs in private appellate cases or in cases from other states involving important consumer protection issues. Negotiate settlement of cases as appropriate. Select cases for enforcement activitywhich will have the most impact on the public.
Represent the Attorney General in multi-state and state-federal efforts to investigate and stop deceptive and fraudulent business practices which are nationwide in scope. Advise and assist other attorneys, specialists and investigators in their duties, including giving appropriate instruction in the law. Work with businesses and business and professional groups, including trade associations, Better Business Bureaus, etc. to develop mechanisms such as best management practices, guidelines or dispute resolution mechanisms to improve protection of consumers and fairness to business. Make presentations to the legislative committees or rule making bodies as necessary. Respond to public inquiries, including those from the press and local law enforcement officials.
This position requires travel and overnight travel.
This position will participate in the Legal Division's criminal briefrotation.Knowledge, Skills and Abilities / Competencies
Extensive and through knowledge of general case, statutory and common law and judicial procedures.
Ability to litigate complex, multi-party cases, many involving substantial constitutional or statutory questions, large sums of money, and issues of first impression. Most of these cases are in the nature of class actions involving large numbers of aggrieved consumers.
Ability to interpret and apply laws and court decisions independently.
Ability to analyze facts, evidence and legal instruments clearly and logically in oral and written form.
Ability to maintain effective working relationships with the public, the business community, and other persons contacted in the course of work.
Considerable knowledge of other North Carolina government agencies, their authority and procedures, and their counterparts in other states and in the federal government.
Specialized knowledge and experience in consumer protection law, with particular emphasis on subject areas assigned.
Ability to remain current with the latest business techniques in areas of specialty and to marshal evidence and new legal theories to address them.
Licensed to practice law by the North Carolina State Bar and one year of professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.Supplemental and Contact Information
